Motorola Mobility has tentatively won a patent lawsuit in Germany that it has with the company Apple Inc. The Mannheim court has issued a preliminary ruling requiring the European branch to Appto stop the distribution and sale of devices that infringe Motorola Mobility's patents. Specifically, these are mobile phones iPhone and iPad tablets in the 3G+WiFi version. The court of course only concerns the German market, not the whole of Europe. However, the dispute could ultimately lead to a complete halt in the sale of iPads 3G+WiFi and iPhones not only in Germany, but also in other European Union countries, which could be inspired by the Mannheim court's decision if Motorola Mobility files the same motion in other countries. "The decision focuses on the European sales organization Applu, but it only applies to sales that this company makes to German customers," says patent law expert Florian Müller.

"We will immediately appeal the court's decision. However, those who will be shopping in Germany for Christmas should have no problem finding exactly the iPad or iPhone"whatever they want," the spokeswoman said Applu Kristin Huguet.

"Motorola Mobility will continue to make every effort to resolve the global patent dispute as soon as possible," Motorola said in a press release. If Motorola decides to exercise its right granted by the German court, it will have to pay a deposit of 100 million euros to the court. Euro, i.e. approximately 2,5 billion crowns. In the event that Apple lawsuitonec won, this deposit or part thereof will cover the costs of lost profits incurred by the company Apple thanks to the ban on the sale of phones and tablets.
